Video Transcribed: Are you being misclassified as a contractor or an employee? I’m Oklahoma Workers Rights Attorney Colby Addison. Whether or not you are a contractor or an employee depends on many broad criteria, and it is a sliding scale of consideration when it comes to certain factors.
Those factors typically come down to how much the employer controls your day-to day-tasks. To be qualified as an employee, you’ll be able to have certain employee rights. You’ll also receive certain employee legal protections as well, and contractors typically are not able to receive those protections.
So if you feel like you are being considered a contractor, but you are actually an employee, there are certain things you need to consider. The first thing is a behavioral sort of control. Does your employer control what you do, when you do it, and how you do it? Is there financial control?
Does your employer determine how you’re paid? Do they reimburse expenses or not? Do you provide your own tools and supplies? Also, there are other types of relationships that might apply as well, such as, do you have a written contract for employment or are you on an at-will basis, or do you have certain employee types of benefits?
