Wrongful Termination Occurs When an Employee Is Fired Illegally
Video Transcribed: What is wrongful termination? I’m Oklahoma Wrongful Termination Attorney Colby Addison, and we are discussing that exact issue. Oklahoma is considered an at-will state, which means an employer can terminate an employee for nearly any reason. But there are exceptions to that. And that’s when wrongful termination comes into play.
Those exceptions include when an employer terminates an employee because of their race, color, religion, or sex, including pregnancy, sexual orientation, gender identity, national origin, age, disability, or genetic information.
Also, if an employer retaliates against an employee for maybe getting injured on the job or filing a worker’s comp case, or if that employee is unwilling to violate some sort of law that the employer is forcing them to act on, that’s an unlawful termination.
And if you are subject to some sort of wrongful termination, you also have the right to file a lawsuit or go through the administrative process with the Equal Employment Opportunity Commission or the Oklahoma Civil Rights Enforcement.
Occasionally, if your termination doesn’t fall into one of those exceptional criteria, you can also file for unemployment and be able to receive unemployment benefits.
